I thought it was up to the next of kin to decide if a person lives or dies.
I also thought 13 year olds were smart enough to make life or death decisions like, say, abortion.
So why, when a 13 year old doesn’t want radiation treatment and her next of kin agree with her is it up to the Texas courts to get involved?
And what if she wants to go home to her family? Children’s rights advocates would fight for her right to leave her family in a bad situation, what about her right to return to a good one?
Of course, the real answer is that what’s right is whatever the courts say is right. There are no real principles. Contradiction is to be expected as our system of laws has become a system of what feels good.
